The Three Affiliated Tribes Tribal Business Council recognizes the opportunity given to the people of the MHA Nation from the oil & gas development on the Fort Berthold Reservation. The People’s Fund has been created for the membership as a source of revenue long after the last barrel of oil is taken from our lands. As we have been fortunate to be blessed with this natural resource that has taken millions of years for Mother Nature to prepare. We shall extend the benefits of this resource perpetually into the future. The People’s Fund will continue to benefit the members of the Three Affiliated Tribes for many generations to come.
The Director and Advisory Board for the People’s Fund and TAT Chief Financial Officer have been working closely with the Office of Special Trustee (OST) to utilize their services in order to realize tax benefits, for members, which are derived by OST issuing the per capita.
The People’s Fund is an annual distribution to all duly enrolled members of the MHA Nation that are 21 and over. Those that are under the age of 21 will have their monies remain in trust with the exception of those currently between the ages of 18 and 21 and attending an accredited college or university or those on active duty with the U.S. Armed Forces or National Guard.
Updates to the distribution date will be posted to the MHA Nation website at www.mhanation.com.
General Disbursements
General Disbursements are not associated with the People’s Fund but are also payments from oil and gas royalties. These are one-time payments to all enrolled members regardless of age. The frequency and amount of the disbursement is at the discretion of the Tribal Business Council. These disbursements allow for minors under the age of 21 to receive the monies. Minors under the age of 14, as of a specified date indicated on the resolution that approves the disbursement, will need to have an Instruction for Disbursement Form (Minor Disbursement Form) completed by the custodial parent or legal guardian.
People's Fund Deduction Information
The Tribal Business Council has the authority per Resolution No. 13-004-VJB - January 04, 2013, to “offset distributions against
liquidated debts owed by the payee to the MHA Nation or any of its agencies” and Resolution No. 14-112-VJB - July 10, 2014,
“Unless there is an approved loan and repayment schedule in effect prior to the distribution close out date of July 1 of the distribution year…
and the member is not in default on that schedule, any monies owed to the Tribe, to any Tribal Enterprise or to the Tribal Court,
shall be deducted from any members distribution at the rate of one half (1/2) of annual…distribution amount until such debt and/or obligation
to the Tribe is paid in full…”
